1. Agreement
These Terms of Service (the "Terms") are an agreement between you and the operator of the hankerchf mobile app and the associated web site at www.hankerchf.com (together, "hankerchf", "we", "us"). By creating an account or otherwise using hankerchf, you agree to these Terms and to our Privacy Policy. If you do not agree, do not create an account and do not use the service.
2. Eligibility
- You must be at least 18 years old to create an account and use hankerchf. There are no exceptions, regardless of the age of majority in your jurisdiction.
- hankerchf is initially available in the United States. We may add or remove supported countries at any time. If you use the service from a country we do not support, your account may be suspended.
- You must not be subject to any United States sanctions list (OFAC SDN List or comparable), and must not be located in any country or territory subject to comprehensive United States trade sanctions.
- You may not use hankerchf if a prior account of yours has been terminated by us for a violation of these Terms.
3. Your account
- You are responsible for keeping your password secure and for any activity that occurs under your account.
- You may only have one personal account. Multiple accounts maintained to evade blocks, bans, or rate limits are a violation of these Terms.
- You must keep your email address current so we can reach you for security, safety, and legal notices.
- You can delete your account at any time from Settings → Delete Account.
4. Acceptable use
You agree not to:
- Use hankerchf to harass, threaten, intimidate, stalk, defame, dox, or discriminate against any person.
- Impersonate any other person, or create a profile that is materially misleading about who you are.
- Upload or send any sexual content involving minors. This is a zero-tolerance category and we report all suspected child sexual abuse material to the National Center for Missing & Exploited Children (NCMEC) and the appropriate law-enforcement authorities, as required by 18 U.S.C. § 2258A and equivalent obligations in other jurisdictions.
- Upload non-consensual intimate imagery of another person.
- Use hankerchf to facilitate trafficking, prostitution where prohibited, the sale or distribution of controlled substances, or any other unlawful activity.
- Solicit money, gifts, cryptocurrency, or other items of value from other users (including by posing as another person, claiming hardship, romance scams, or "sugar" arrangements).
- Send spam, chain messages, mass-advertising, or unsolicited promotional content.
- Reverse engineer, scrape, crawl, or otherwise extract data from the service in bulk; circumvent rate limits; or operate automated software that interacts with the service without our written permission.
- Upload viruses, worms, malware, or any software intended to disrupt the service.
- Use the service to discriminate based on race, color, ancestry, national origin, religion, disability, sex, gender identity, sexual orientation, age, citizenship, marital status, or veteran status in a manner that violates applicable law.
We may suspend or terminate any account, and remove any content, that we in good faith believe violates these rules. Suspension is generally reviewable on request; termination for safety violations (CSAM, NCII, threats of violence, doxxing) is not.
5. Your content
You retain ownership of the photos, profile text, and messages you upload to hankerchf. To operate the service, you grant us a non-exclusive, worldwide, royalty-free, transferable, sublicensable licence to host, store, reproduce, modify (for the purpose of resizing, format conversion, and automated moderation), display, and transmit your content to other users of the service, solely for the purpose of operating, providing, and improving the service. This licence ends when you delete the content or your account, except where:
- Other users have already received content from you (messages, photos) — copies they retain are outside our control;
- We are legally required to retain a copy (e.g. content reported as CSAM, preserved for law enforcement); or
- Aggregated, de-identified data derived from your content survives in analytics that cannot be re-associated with you.
You represent and warrant that you own or have the necessary rights to all content you upload, and that the content does not violate any third- party rights or any law.
6. Consent and sensitive information
hankerchf collects "Sensitive Personal Information" (SPI) under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (CCPA/CPRA), and the equivalent "sensitive data" categories under other US state privacy laws. This includes sexual orientation, gender identity, health status, ethnicity, precise geolocation, and the contents of personal communications. Our handling of this information is governed by the Privacy Policy. Key points:
- We ask for your affirmative, separate consent before collecting any sensitive field, and you can revoke any of those consents at any time from Settings.
- HIV status, last-tested date, and vaccination status are never used for advertising or for AI training and are never made into filter criteria.
- We do not sell or share your personal information for cross-context behavioural advertising. We have no advertising partners.
7. Safety, moderation, and reporting
- Public profile pictures are reviewed by automated moderation before they become visible to other users, and may be reviewed again afterward. We may remove any photo that violates these Terms or our community guidelines.
- Public group chats are moderated. Messages sent in public group chats are screened by automated filters against our community guidelines, and our safety team may remove content or remove participants who violate these Terms.
- You can block any user; blocking removes them from your inbox, hides them from your grid, and prevents them from contacting you.
- You can report any user or message; reports are reviewed by our safety team.
- We may suspend or terminate accounts that receive multiple credible reports, even if no single report is individually conclusive.
- We cooperate with law-enforcement requests that are lawful and properly served. Where the law permits, we will notify affected users before complying.
8. Paid features (when offered)
hankerchf is currently free to use. If we introduce paid features or subscriptions in the future, those terms will be presented at the point of purchase and incorporated by reference into these Terms.
9. Termination
- You may terminate your account at any time via Settings → Delete Account or by writing to [email protected].
- We may suspend or terminate your account at any time for a violation of these Terms, for safety reasons, or as required by law.
- The provisions of sections 5 (last paragraph), 10, 11, 12, and 13 survive termination.
10. Disclaimer of warranties
hankerchf is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade.
We do not conduct background checks on users. We do not verify the identity, age, criminal history, immigration status, health status, or any other attribute of any user beyond the limited verification described in the Privacy Policy. You are responsible for exercising your own judgement about who you communicate with and who you meet.
11. Limitation of liability
To the maximum extent permitted by law, hankerchf and its operators are not liable for:
- Any indirect, incidental, special, consequential, exemplary, or punitive damages;
- Any loss of profits, revenue, data, goodwill, or business opportunity;
- Any damages resulting from your use of, or inability to use, the service; from any conduct or content of any other user; or from any unauthorised access to or alteration of your transmissions or data.
In any case, our total aggregate liability arising out of or related to these Terms or the service shall not exceed the greater of (a) the amounts you have paid us for the service in the twelve months preceding the event giving rise to the claim, or (b) one hundred United States dollars (USD $100).
Some jurisdictions do not allow the exclusion of certain warranties or limitations on certain liabilities. To the extent that any such exclusion or limitation is unenforceable in your jurisdiction, that exclusion or limitation shall apply only to the maximum extent permitted by law. Nothing in this section limits liability for fraud, gross negligence, or death or personal injury caused by negligence.
12. Indemnity
You agree to indemnify, defend, and hold harmless hankerchf and its operators, employees, contractors, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:
- Your breach of these Terms;
- Your content;
- Your interactions with other users; or
- Your violation of any law or the rights of any third party.
13. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States of America, without regard to its conflict-of-laws rules. The federal laws of the United States apply where relevant (including but not limited to 18 U.S.C. § 2258A, the Children's Online Privacy Protection Act, and applicable consumer-protection statutes). The mandatory consumer-protection laws of your state, province, or country of residence (where applicable) are not affected by this choice.
Any dispute arising out of or related to these Terms or the service shall be subject to the exclusive jurisdiction of the state and federal courts located in Wilmington, Delaware, except that consumers may also bring proceedings in the courts of their state, province, or country of residence where applicable law so requires. Small-claims matters may be brought in the court of competent jurisdiction in the plaintiff's home state or province.
You and we each waive the right to a trial by jury for any dispute arising out of or related to these Terms, to the maximum extent permitted by law. You and we each agree to bring claims only in your or our individual capacity and not as a plaintiff or class member in any purported class or representative proceeding, to the maximum extent permitted by law.
14. Changes to these terms
We may revise these Terms from time to time. Material changes will be announced in the app at least 30 days before they take effect. Continued use of the service after the effective date constitutes acceptance.
